MEMORANDUM OF UNDERSTANDING

 

Patrick Ball, Director of Human Rights Programs at The Benetech Initiative, and

Mirsad Tokaca, President of the Research and Documentation Center of Sarajevo ( R D C ),

jointly recognize:

•  After two days of meetings and technical exchange, we note that our independent technical developments have converged, validating our common model;

•  We have learned much together, and we look forward to collaborating in the future, to advance our knowledge about war crimes and human rights violations in BiH, and to advance the methodology and technology of data management and analysis in human rights;

•  To this end, we create this memorandum of understanding in order to clarify our respective contributions, roles, and expectations;

 

1) RDC requests that Benetech conduct an initial evaluation of the RDC database. This will include:

a) A discussion of the structure of the RDC database of the " Population losses 92 - 95 " project.

b) RDC requests that Benetech evaluate the internal overlap structure of deaths and missing persons in order to calculate initial and preliminary analysis of the RDC data.

c) RDC will provide Benetech with data ( to Benetech's specifications ) for the calculation of the analysis described in ( a ) and ( b ).

2) The parties agree that they will seek additional funding for new phases of work. Both parties will investigate potential funding sources. Both parties will consult with the other in funding applications that mention the other party, including the relevant budget portions of the proposals. The mentioned party has the right to remove themselves from the proposal if necessary.  

3) RDC will immediately begin writing a budget and conduct fundraising for the second phase of " Population Losses 92 - 95 " project. Benetech will assist and review in the proposal generation. The initial data analysis conducted by Benetech will be done in time for the preliminary proposal drafts.

4) Benetech promises to maintain all shared data in complete confidence. This will mean that Benetech will not share or publish the data or analysis until RDC determines that such use would be beneficial.

5) Both parties agree that their work together in the region, they will keep each other informed and consult each other. It is especially important for Benetech to consult RDC about potential projects or collaborations in the region.

 

For Benetech, the exceptions to this agreement will be pre - existing relationships with groups in Kosovo.

Both groups will maintain independent relationships with the ICTY.
